1. Acceptance of Terms

By downloading, installing, or using JUST START ("the App"), you agree to comply with these Terms & Conditions. If you do not agree with any part of these terms, do not use the App.

2. Service Description

JUST START is a personal development application designed to help users build discipline through progressive challenges. The App includes:

• Discipline Challenges: Structured challenges from 21 to 90 days divided into progressive phases
• Energy System: Gamified mechanic reflecting your consistency and performance
• Daily Actions: Minimal daily tasks you must complete to progress
• AI Coach: Personalized notifications based on your progress and behavior
• Challenge History: Permanent record of completed challenges
• Premium Subscription: Unlimited access to challenges and advanced features

3. Registration & Account

3.1 Registration Requirements

• You must provide accurate and complete information during registration
• You can register using email/password or Google Sign-In
• You must keep your password confidential
• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.

3.3 Device Permissions

The App may request access to certain device features (for example, camera or photo gallery) only when you explicitly choose to use features that require them, such as the Social Proof or sharing templates. These permissions are requested at the time of use and are not required to simply use the core features of the App.

• You may grant or deny these permissions; denying a permission will disable the related feature.
• Permissions can be revoked at any time through your device settings.
• When you grant permission, photos or screenshots are processed locally to prepare them for sharing (templates, overlays, cropping). By default, we do not upload or retain these images on our servers unless you explicitly choose to upload or save them to a cloud-backed feature.
• When you share content using a third-party app or service, that third party's terms and privacy practices will apply to the shared copy.

4. Trial & Subscriptions

4.1 Free Trial

• Duration: 3 days from the start of the first challenge
• Scope: Full access to a challenge for the first 3 days
• One-Time Use: The free trial can only be used once per account
• Non-Transferable: Abandoning or completing a challenge consumes the trial
• Limit: From day 4 onward, a Premium subscription is required

4.2 Premium Subscription

• Unlimited Access: Start, repeat, and complete challenges without restrictions
• No Day Limits: No trial day restrictions
• Advanced Features: Access to all app features
• Auto-Renewal: Subscriptions renew automatically according to the chosen plan

4.3 Billing & Payments

• All payments are processed exclusively through Google Play Store and Apple App Store
• UpbelStudio does not process payments directly or store payment information
• Subscriptions automatically renew at the end of each billing period unless canceled before renewal
• Prices may change with notice; changes will not affect an active paid period

4.4 Cancellation

• You can cancel your subscription at any time through your app store settings
• Cancellation becomes effective at the end of the current billing period
• You will retain Premium access until the end of the paid period
• No prorated refunds are offered for early cancellations

4.5 Refunds

• Refund requests are governed solely by the policies of Google Play Store and Apple App Store
• UpbelStudio does not provide direct or manual refunds
• If the store approves a refund, Premium access will be revoked automatically

5. Energy System & Challenges

5.1 Energy Mechanics

• Energy reflects your performance and consistency in a challenge
• Completing daily actions increases your energy
• Missing daily actions decreases your energy
• Energy can reach zero, which may lock the challenge for free users
• The energy system is for gamification and has no monetary value

5.2 Challenge Rules

• Each challenge has a specific duration (21, 90 days, etc.)
• Challenges are divided into phases with progressively stricter rules
• You must complete a minimum daily action each day
• You cannot "bank" days or recover missed days
• Abandoning or completing a challenge consumes the trial for free users

5.3 Challenge History

• Completed challenges remain accessible in read-only mode
• History is never locked, even without an active subscription
• Statistics and progress from completed challenges are permanent

6. AI Coach

6.1 Personalized Notifications

• The Coach uses AI to generate notifications based on your progress
• Notifications adapt to your behavior and usage patterns
• You can customize the time of daily notifications
• You can disable notifications at any time

6.2 Content Accuracy

• Notifications are generated by AI
• We do not guarantee the accuracy or effectiveness of generated messages
• Content is for motivational and educational purposes only
• Do not rely solely on notifications for important decisions

7. Intellectual Property

7.1 App Rights

• JUST START and all its content are the property of UpbelStudio
• You may not copy, modify, distribute, or sell any part of the App
• All rights not expressly granted are reserved

7.2 User Content

You retain ownership of any content you create, submit, or upload through the App, including challenge progress, text, photos, and other materials ("User Content"). By submitting User Content, you grant UpbelStudio a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, process, and display that content solely to provide and improve the Service, including enabling sharing features, generating templates, and caching content temporarily for display purposes.

Specific terms regarding images and Social Proof:

• Local processing: Images captured or selected for Social Proof are processed on your device to generate templates, overlays, or exports. Temporary files used for processing are deleted promptly after the operation completes.
• No default server storage: By default, we do not upload or permanently store Social Proof images on our servers or in our database. If you explicitly choose to upload an image to a cloud-backed feature or enable a backup, that image may be stored according to the policy you opt into.
• Sharing: When you share User Content via the App, we may invoke your device's native share flow or pass the content to a third-party service. Once shared, the recipient's terms and privacy practices apply and UpbelStudio is not responsible for third-party handling of that content.
• Responsibility and rights: You represent and warrant that you have all rights necessary to submit the User Content and to grant the license above. You are responsible for the content you share and must not submit content that infringes third-party rights, violates law, or breaches these Terms.
• Removal and moderation: While we do not generally monitor private User Content, we reserve the right to remove or disable access to any User Content that we believe violates these Terms, applicable law, or our policies (for example, abusive or infringing content).

8. User Conduct

You agree NOT to:

• Use the App for illegal or unauthorized purposes
• Attempt to access unauthorized systems or data
• Interfere with the operation of the App
• Harass, abuse, or harm other users
• Provide false or misleading information
• Use bots, scripts, or automated tools
• Resell or redistribute the service without authorization
• Exploit bugs or vulnerabilities for unfair advantage

10. Limitation of Liability

10.1 Use at Your Own Risk

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

10.2 Disclaimer of Warranties

WE DO NOT GUARANTEE THAT:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is secure or free of viruses
• Challenge results will be accurate or reliable

10.3 Limitation of Damages

IN NO EVENT WILL WE BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data, progress, or subscriptions
• Damages exceeding the amount paid for subscription in the last 12 months

10.4 Health & Wellbeing

• JUST START is a productivity tool, not a substitute for medical or psychological advice
• We are not responsible for decisions made based on app use
• Consult a professional if you have mental or physical health concerns

11. Indemnification

You agree to indemnify and hold us harmless from any claim, damage, loss, or expense (including attorney fees) arising out of:

• Your use of the App
• Your breach of these Terms
• Your infringement of third-party rights

12. Service Changes

We reserve the right to:

• Modify or discontinue the App at any time
• Change features or functionality
• Update these Terms with prior notice
• Suspend or terminate accounts that violate these Terms

13. Termination

13.1 By Us

We may suspend or terminate your access if:

• You violate these Terms & Conditions
• You use the App fraudulently
• You fail to pay subscription fees
• For any other reason at our discretion

13.2 By You

You may terminate your account at any time:

• By deleting the App
• By canceling your subscription
• By requesting account deletion in settings

13.3 Effects of Termination

Upon termination:

• You will lose access to all premium features
• Your data may be deleted per our Privacy Policy
• Completed challenge history may be retained in anonymized form
• Outstanding payment obligations remain in effect

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Peru. Any dispute will be resolved in the courts of Lima, Peru.

15. Dispute Resolution

15.1 Informal Negotiation

Before initiating any legal action, you must contact us at upbelstudio.help@gmail.com to attempt to resolve the dispute informally.

15.2 Arbitration

If the dispute cannot be resolved informally within 30 days, the dispute will be submitted to binding arbitration under the laws of Peru.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and UpbelStudio regarding the use of JUST START.

16.2 Severability

If any provision is invalid or unenforceable, the remaining provisions will remain in effect.

16.3 Waiver

Our failure to exercise a right does not constitute a waiver of that right.

16.4 Assignment

You may not transfer these Terms without our consent. We may assign them freely.

16.5 Language

In case of conflict between versions in different languages, the English version will prevail.
